Eligibility

You must work for an employer with 50 or more employees within 75 miles, have worked there at least 12 months, and have worked at least 1,250 hours in the past year. Public employers and schools are covered regardless of size. Ohio has no state family leave law extending coverage beyond federal FMLA.

What FMLA Protects

Your job (or an equivalent one) is protected during leave. Health insurance continues on the same terms. Your employer cannot retaliate for taking FMLA leave. FMLA does not protect against discipline for misconduct that occurred before leave — including workplace substance use — and does not require paid leave, though employers may allow use of accrued PTO.

How to File

Notify HR that you need medical leave (you need not disclose the diagnosis). HR provides certification forms for your treating provider. Federal confidentiality law (42 CFR Part 2) limits what treatment programs disclose; your employer learns you have a serious health condition, not the specifics.
