Addiction treatment records are protected by federal law more stringently than almost any other medical information. 42 CFR Part 2 prohibits disclosure of substance use disorder treatment records without your specific written consent — even to employers, family, or law enforcement in most circumstances. This federal regulation, stricter than HIPAA, covers any information that would identify you as a patient in a substance use disorder treatment program. It cannot be disclosed without your written consent specifying the recipient and purpose. Exceptions are narrow: medical emergencies, certain research and audits, court orders meeting specific standards (a subpoena alone is not enough), and reports of child abuse. Records cannot be used to prosecute you.
What Your Employer Can Learn
If you use FMLA, your employer learns you have a serious health condition — not the diagnosis. If you use insurance, your employer does not see claims (though self-funded plan administrators may). If you self-disclose to HR or EAP, that information has its own protections. Drug testing at work is separate from treatment records.
Courts and Law Enforcement
Treatment programs cannot disclose your records to police or prosecutors without a court order that meets Part 2’s specific requirements. If you are in drug court or on probation, you consent to specific disclosures as a condition of participation.
